The “Report of Inventions and Subcontracts” form is a document used by the government to report inventions that are being developed under a contract. These reports must be submitted to the Procuring Contracting Officer within the deadline indicated on the form. If a contractor has subcontractors that have patent rights clauses in their contracts, the DD Form 882 is the required form for reporting these subcontracts.
The DD Form 882 is divided into three sections. Blocks 1 and 2 contain information on the Contractor and the Subcontractor. Blocks 3 and 4 indicate the type of report. For small businesses, the final report must be submitted within six months. Unless a specific deadline is specified, the contractor must provide interim reports to the Procuring Contracting Officer every 12 months.
A copy of the completed DD Form 882 must be submitted to the Procuring Contracting officer. This report is then forwarded to Patent Counsel. After review, Patent Counsel will make a determination if the inventions are patentable. If patentability has been established, the patent application may be filed in the United States or other countries.
Before the anticipated award end date, the Principal Investigator should review the award terms and conditions. He or she should also refer to the award document to verify the due date. Once the due date has been determined, the Principal Investigator should fill out the form.
